Welcome to OHPHAMMER. These Terms of Service govern access to ohphammer.shop and purchases made through our online store. Please read them carefully before completing a purchase.

1. Definitions

“We”, “us” and “our” mean OHPHAMMER and the legal operator of the website. “You” means a customer or website visitor. “Products” means goods offered for sale. “Order” means a purchase request submitted through checkout.

2. Acceptance

By placing an order, customers agree to the applicable purchase terms. Customers must provide accurate information and have the legal capacity or appropriate authorisation to make a purchase.

3. Website use

Customers may browse products, make purchases, manage available account features and contact support. Prohibited activities include fraud, malware distribution, unauthorised access, disruption and unlawful copying of protected content.

4. Products and prices

Product specifications, measurements, technical capacities and descriptions are provided to help customers choose appropriate equipment. All prices are in USD and include applicable sales tax. Product details should be checked carefully before purchase. Where obvious errors occur, orders may be declined before acceptance and any collected payment refunded.

5. Orders and contract formation

Submitting an order constitutes an offer to purchase. An automatic acknowledgement confirms receipt. The contract is formed when the store accepts the order and confirms dispatch. Order refusal may occur for legitimate reasons such as unavailability, pricing mistakes, failed payments or suspected fraud.

6. Payments and ownership

Stripe processes payments. Available payment methods are displayed at checkout. Payment is collected at order placement. Ownership transfers in accordance with the contract and applicable law. For consumer deliveries arranged by the store, risk generally remains with the store until the consumer or their nominated recipient takes physical possession.

7. Shipping

Free standard shipping to contiguous United States addresses. Processing: 1–2 working days. Transit: 3–6 working days. Estimated total: 4–8 working days. Large equipment may require pallet freight and curbside delivery. Consult the shipping policy.

8. Returns and refunds

Eligible change-of-mind returns can be requested within 30 days. Customers bear direct return delivery costs for change-of-mind returns where lawfully disclosed. The store covers applicable costs for faulty, damaged or incorrectly supplied goods. No restocking fees. Statutory cancellation rights remain unaffected. See the returns & refunds policy.

9. Product warranties

Manufacturer warranties vary by product. No universal additional warranty term is promised. Statutory product quality and faulty-goods rights remain in force. See the warranty & replacement policy.

10. Intellectual property

Website branding, text, photographs and designs are protected where applicable. Customers may use content for personal lawful purposes. Commercial reproduction requires permission from the rights holder.

11. Customer reviews

Customer feedback must not be unlawful, fraudulent or misleading. Where customers submit reviews, the website may display and moderate them in accordance with applicable law.

12. Privacy

Personal information is handled according to the privacy policy and cookie policy.

13. Liability

Nothing in these terms limits liability for death or personal injury caused by negligence, fraud or another liability that cannot lawfully be excluded. Consumer statutory rights remain unaffected.

14. Safe use of equipment

Customers must follow applicable product instructions and safety guidance. Examples include:

• Excavators and skid steer loaders must be operated by trained adults following the operator manual and site safety rules.
• Stump grinders and wood chippers must be used with appropriate eye, hearing and foot protection, and never fed by hand inside the hopper.
• PTO-driven equipment must only be connected to tractors meeting the stated horsepower, hitch and hydraulic requirements.
• Machinery must be transported on trailers rated for its weight and secured according to applicable road rules.
• Heavy equipment should be moved and installed by competent persons using appropriate equipment.

Assembly and installation services are not included unless specifically agreed. These instructions do not remove statutory product safety obligations.

15. Third-party links

Links may lead to external courier, payment or information services. Those services have their own terms and privacy practices.

16. Payment providers

Transactions may also be subject to applicable bank and payment-provider rules.

17. Events outside reasonable control

Severe weather, industrial action and major transport disruption may cause delays. We will communicate material delays and respect applicable cancellation and refund rights.

18. Complaints

Contact support@OHPHAMMER.shop with the order reference. We aim to respond within 1 working day.

19. Governing law

These terms are governed by the laws of the State of Florida, United States, subject to mandatory consumer protections and applicable court jurisdiction rules. Consumers retain any protections provided by the laws of their own state.

20. General provisions

If one provision is unenforceable, remaining valid provisions continue where legally appropriate. Failure to enforce a right immediately does not automatically waive it. Purchase records and confirmations may be sent electronically.

21. Changes

Updates may be published on this website. Changes do not retrospectively remove statutory rights or rights under existing contracts.
